Compensation for tourist rentals in the Basque Country in 2022

On Saturday March 5, the Basque Country Agglomeration Community adopted the principle of compensation for Airbnb-type furnished tourist rentals in 24 municipalities classified as tight areas. This measure aims to reduce the strong tension on housing on the Basque Coast, and the inflation of rents.

The municipalities concerned by this regulation are as follows:
Ahetze, Anglet, Arbonne, Arcangues, Ascain, Bassussarry, Bayonne, Biarritz, Bidart, Biriatou, Boucau, Ciboure, Guéthary, Hendaye, Jatxou, Lahonce, Larressore, Mouguerre, Saint-Jean-de-Luz, Saint-Pierre-d' Irube, Urcuit, Urrugne, Ustaritz, Villefranque.

Thus, from June 1, 2022, for any request to change the use of an accommodation into a furnished tourist rental, the owner must create a rental accommodation for the year of the same surface, in the same city.
This new provision does not apply to main residences put up for seasonal rental within the limit of 120 days per year. Housing rented at least nine months per year to students, and housing included in the right-of-way of the main residence will also benefit from an exemption.
